Terms of Use

These terms govern your use of Wholefit, operated by Ivan Kachur. By using Wholefit you agree to them. If you don't agree, please don't use Wholefit.

What Wholefit is

Wholefit is a discovery service. We show outfits assembled by our algorithm from products listed by independent brands, and link you to those brands to buy. Wholefit is not a store. We don't sell, ship or take payment for anything, and we're not a party to your purchase.

Eligibility

You must be at least 13 years old (16 in the European Union) to use Wholefit, and at least 18 (or have a parent's permission) to buy from a brand.

What you need

Wholefit works in current versions of common web browsers with JavaScript turned on. Saving likes and choices on your device needs your browser's storage; an account or emails need an email address. Using Wholefit is free.

Your account

You can use Wholefit without an account. If you create one (with Google, or with an email and password), keep your sign-in safe; you're responsible for activity on your account. You can delete it, which ends this agreement, at any time from your account page. We may suspend or close accounts that misuse Wholefit or break these terms.

Products, prices and stock

Product names, photos, prices, sizes and availability come from the brands and are refreshed daily, so they can be out of date or wrong. The price and availability on the brand's site at checkout are what count. The same goes for each brand's shipping and returns terms, which we read from its own policy pages and checkout and show on looks and pass to search engines; the brand's terms at checkout are what apply. Outfit suggestions, “why it works” notes and size matching are generated automatically and are suggestions, not professional advice.

Purchases from brands

When you click “Buy” or “View product” you leave Wholefit. Your order, payment, shipping, returns, warranties and customer service are handled by the brand under its own terms and privacy policy. Contact the brand about any problem with an order. Wholefit may earn a commission on purchases (see the Affiliate Disclosure).

Acceptable use

Don't:

• scrape, copy or resell Wholefit's content or data in bulk, or access it with automated means except search engine crawlers;
• interfere with Wholefit's security or operation, or overload it;
• misuse links, click ids or affiliate tracking, or generate fake clicks or events;
• use Wholefit for anything unlawful, or send us unlawful content.

Intellectual property

Wholefit's own design, code, logo and text belong to Ivan Kachur. Brand names, logos and product images, including where they appear in Wholefit's outfit pictures and pins, belong to their owners and are shown to identify and link to their products. Wholefit is not affiliated with or endorsed by the brands (see Brands & Copyright).

Disclaimers

Wholefit is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that Wholefit is accurate, uninterrupted or error-free, and we're not responsible for brands' products, sites or conduct.

Limitation of liability

To the fullest extent permitted by law, Ivan Kachur won't be liable for indirect, incidental, special, consequential or punitive damages, or for any loss arising from purchases made from brands. Our total liability for any claim relating to Wholefit is limited to $50. Nothing in these terms limits liability that the law doesn't allow to be limited, such as for harm caused intentionally or through gross negligence, or for death or personal injury, or takes away rights you have as a consumer under mandatory law.

Indemnity

To the extent the law allows, you agree to indemnify Ivan Kachur against claims arising from your misuse of Wholefit or breach of these terms.

Complaints

If something on Wholefit doesn't work as it should, email hello@getwholefit.com with what happened and the page it happened on. We'll reply within 14 days. Problems with an order go to the brand you bought from. If we can't resolve your complaint, we'll tell you in writing whether we agree to an out-of-court dispute resolution procedure.

Governing law and disputes

These terms are governed by the laws of the State of Delaware and applicable US federal law. Disputes will be resolved in the state or federal courts located in Delaware, unless the law where you live requires otherwise. If you live in the United Kingdom or the European Union, its section below applies instead.

If you live in the United Kingdom

If you live in the United Kingdom, the Disclaimers, Limitation of liability, Indemnity and Governing law and disputes sections above don't apply to you. Instead, we're responsible for loss you suffer that is a foreseeable result of our breaking these terms or not using reasonable care and skill, but not for loss that isn't foreseeable, and not for business losses. We don't exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us exclude. These terms are governed by the law of the part of the United Kingdom where you live, and you can bring proceedings in its courts. Nothing here affects your statutory rights.

If you live in the European Union

If you live in the European Union, these terms are governed by Polish law, where Wholefit is run from. As a consumer you also keep the protection of the mandatory rules of the country where you habitually live (Art. 6(2) Rome I Regulation). You can bring proceedings against us in the courts of Poland or of the EU country where you are domiciled; we can bring proceedings against you only in the courts of the country where you are domiciled (Art. 18 Brussels I bis Regulation).

The Disclaimers, Limitation of liability, Indemnity and Governing law and disputes sections above don't apply to you. We are liable to you under the statutory rules. Nothing in these terms excludes or limits our liability where the law that protects you as a consumer doesn't allow it. Your statutory rights as a consumer, including those for digital services, are unaffected.

Changes

We may change these terms for a valid reason: a change in the law or a court or authority's decision, a new or changed feature of Wholefit, security, or to make them clearer. We'll change the date below, email account holders at least 30 days before a material change, and ask you to accept it when you next sign in; until you do, the earlier terms apply to you. If you don't agree, you can delete your account at any time, free of charge. Changes never apply to the past.

Language

These terms are in English and German. For the German site (/de) the German version governs; for every other site, the English.
